LA & OC Divorce Financial Mediation
Greg has a very small divorce financial mediation practice. It is limited to the semi-complex property and income issues that he often analyzes for his litigated cases. He charges a flat fee and is very selective. If your case is complex, then he will refer you to a divorce attorney and an attorney-mediator. Greg believes that you should dissolve your marriage and not your wealth. Your wealth is your time, money, and emotion. And you do not have an endless supply of any. His divorce approach is simple. Greg believes that you use divorce mediation to “prevent” litigation so that you can “preserve” your wealth and “prepare” for an independent life. His mediation clients must share his philosophy.
The Cost of Divorce (Maybe Your Retirement)
From Greg's experience, a typical litigation takes between one and seven years and the average attorney retainer is between $5,000 and $10,000 per litigant. However, the retainer is not the final cost. It is just the beginning of what can cost between $15,000 and $30,000 per litigant before it even goes to trial. A divorce that goes to trial can cost between $30,000 and $100,000 per litigant, which would take between $42,000 and $140,000 in pre-tax earnings just to pay for it. Plus, if you assign a value to your time and emotion, then the cost of your divorce increases much more. While divorce litigation is expensive, it is necessary in many cases.
Why is Divorce Expensive?
There are valid reasons why divorce litigation is expensive. Uncertainty is a big reason. Divorce is uncertain because you have minimal control over the people and the process. You only have 100% control in hiring and firing your attorney. Some litigants have argued that their attorney has all the control and they often feel powerless during the process. Other litigants have compared the process they will never fully understand to the Wild West. Though the analogy may be unfair, it is the most understood. Many litigants realize that there was a better way only after they dissolved their wealth. Uncertainty is an endless road and it is expensive. Therefore, the key to decreasing your uncertainty is to increase your control. Mediation gives you control.
